Terms of Service Draft

These Terms govern your use of the Flexxit app and website (the "Service"), operated by [Operator legal name], [address], Greece ("Flexxit", "we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use Flexxit

You must be at least 16 years old to create an account. By registering you confirm that you meet this age requirement and that you are legally able to enter into these Terms. If we learn that an account belongs to someone under 16 we will delete it.

2. Your account

• One account per person. Keep your password private; you are responsible for everything that happens under your account.
• Your username is public. Choose one that does not impersonate another person or brand and does not contain offensive language.
• You can change your email, username and password, and delete your account, from Settings at any time.

3. What Flexxit is

Flexxit lets you upload short videos ("flexxes") showing a skill, rate other people's flexxes from 1 to 5 stars, follow other flexxers, comment, chat, and compete in category rankings such as the Hall of Fame and Rising. Rankings are calculated automatically from ratings and engagement, may change at any time, and have no monetary value. Emblems, badges and ranks are not prizes and confer no rights.

Rankings can be viewed worldwide or per country; a flexxer's country is the country of the mobile number they verified. Each closed month, a Flexxer of the Month title is awarded per category, worldwide and per country, and recorded permanently. Legacy marks the first 1,000 accounts, worldwide and in each country, whose approved flexx received a rating. A title or a Legacy seat is a permanent record tied to your account: it cannot be sold or transferred, has no monetary value, and ends when the account is deleted. Seat numbers are handed out once and never reassigned. You can keep your country out of all of this in Settings → Privacy ("Show my country").

4. Your content

You keep ownership of the videos, thumbnails, descriptions, comments, messages, profile photo and bio you post ("Your Content"). So that we can run the Service you grant Flexxit a worldwide, non-exclusive, royalty-free licence to host, store, transcode, generate thumbnails from, display and distribute Your Content within the Service, for as long as it remains on the Service. Deleting a flexx or your account ends this licence, except for copies held briefly in backups.

You promise that you have all rights needed to post Your Content, including for any music, people or brands that appear in it, and that posting it does not violate anyone's rights or any law. Approved flexxes, your username, profile photo, bio, ratings and ranks are visible to other users, or only to your fans if you set your account to private.

5. Community rules

Flexxit is a place for skills. We have zero tolerance for objectionable content and abusive users. You may not post, send or do anything that:

• is sexual or pornographic, or sexualises minors in any way;
• shows or promotes violence, self-harm, cruelty to animals, terrorism, or dangerous acts performed by or endangering minors;
• harasses, threatens, bullies, doxxes or discriminates against anyone, or targets someone with hate based on race, ethnicity, religion, gender, sexual orientation, disability or similar characteristics;
• is spam, a scam, misleading, or promotes illegal goods or services;
• infringes copyright, trademarks or other rights, including uploading videos that are not yours;
• manipulates ratings or rankings, for example through fake accounts, vote trading or automation;
• attempts to access other users' data, reverse engineer, overload or otherwise interfere with the Service.

6. Moderation, reports and blocking

• Review before publication. Every flexx is reviewed before it becomes visible to others. Review may use automated tools as well as human moderators; we may reject a flexx without giving a detailed reason.
• Reports. You can report any flexx, comment or user from inside the app. We look at reports promptly and act on objectionable content, typically within 24 hours, by removing it and, where warranted, suspending the account that posted it.
• Illegal content. Something illegal that you cannot report from inside the app, or a report from an authority, a hotline or a rights holder: [email protected].
• Blocking. You can block any user; blocked users cannot message you and their content is hidden from you.
• Suspensions. We may remove content, hide comments, restrict features or suspend accounts that breach these Terms, with or without notice. Suspended users are told the reason and can appeal from inside the app. Serious or repeated breaches lead to permanent removal.
• Appeals. If a flexx is rejected, a comment hidden, or your account suspended, you can submit an appeal in the app. A person reviews every appeal.

7. Messages

Chats are private between the participants and are not end-to-end encrypted. We do not read messages in the ordinary course of running the Service, but we may access them where the law requires it or to investigate a report of abuse.

8. Our intellectual property

The Flexxit name, logo, app, website, design and software belong to us or our licensors. Except for Your Content, you may not copy, modify, distribute or create derivative works from any part of the Service without our written permission.

9. Ending your account

You can delete your account at any time from Settings → Delete account (see how deletion works). We may suspend or terminate your account if you breach these Terms or if we discontinue the Service. Sections 4 (for the time content was live), 8, 10, 11 and 12 survive termination.

10. Disclaimers

The Service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted or error-free, or that rankings will favour any particular user. Content posted by users is their own; we do not endorse it and we are not responsible for it, although we moderate it as described above. Nothing in these Terms limits rights you have as a consumer under mandatory law.

11. Limitation of liability

To the extent permitted by law, Flexxit is not liable for indirect or consequential loss, loss of data, loss of profits or reputational harm arising from your use of the Service or from content posted by other users. Our total liability for any claim is limited to €50 or the amount you paid us in the 12 months before the claim, whichever is greater. This does not exclude liability for intent, gross negligence, death or personal injury, or any liability that cannot be excluded by law.

12. Governing law

These Terms are governed by the laws of Greece. Disputes are subject to the courts of [city], Greece, without prejudice to any mandatory consumer protection rules of the country where you live. You may also use the EU online dispute resolution platform at ec.europa.eu/consumers/odr.

13. App stores

If you downloaded Flexxit from the Apple App Store or Google Play, you also agree to their terms. Apple and Google are not parties to these Terms, have no obligation to provide support or maintenance for the app, and are not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes

We may update these Terms. If a change is significant we will tell you in the app or by email before it takes effect. Continuing to use the Service after that date means you accept the new Terms.
